THE PROCESS WORKS SMOOTHLY FOR MOST PLAINTIFFS,
BUT SLOWS DOWN ON THE ISSUE OF PENALTY PAY.


So far, we have processed claims calculations for 1702 Plaintiffs. These calculations have been reduced to Judgment for 1485 Plaintiffs.

1241 Plaintiffs have been paid.

This is out of 1761 total Plaintiffs in the case. We are missing 42 Plaintiffs. Please visit our website and see if you recognize any of the names of missing Plaintiffs.

However, for some Plaintiffs this claim process has slowed down. The State decided that five years ago it missed an offset for approximately 20 Plaintiffs for compensatory time that they had received along with the overtime they worked. Recently Judge Lipscomb allowed the State to refuse to process claims where we had already thought we had “accepted” the State’s offer of claim calculations. This will slow up the process for those Plaintiffs.

In addition, the State has begun to send us its calculations for penalty pay for those Plaintiffs who terminated their employment with the State. However, our attempt to begin to process led to a response from a number of Plaintiffs indicating that the State had their final salary at an incorrect amount. This has caused us to slow down the process as we requested proof from the State on every Plaintiff’s final salary if they are eligible for penalty pay. We are hopeful that late this year or early next year the payouts to all Plaintiffs will be finally concluded.

The brief for interest on your late payments has been filed with the Court of Appeals. However, there are no time lines and a final decision is a couple of years away.
