Re: Young v. State

Case No: 97C10933

Gentlemen:

The attorneys fees are set at 15% for those individual cases that are accepted based upon the claimants' initial submissions. For those which are contested, or which were not immediately accepted because they were not timely filed, for those Mr. Hoag had to request an extension, or otherwise intervene or those he had to track down through an internet search, etc., the reasonable attorneys fees are set at 25% of the ultimate award.

I am allowing plaintiffs' motion to extend the deadline for good cause shown, in part. An extension of the deadline was discussed and anticipated even in advance of setting it. There is even a stipulation which recognizes that likelihood. Other deadlines in this case have been extended to accommodate the parties and their attorneys, including the State of Oregon.

I am extending the initial deadline to February 15 for all parties who have filed a claim or requested an extension by then.

Additional deadline extensions will be granted only on a case-by-case basis thereafter. Of those persons just now being contacted for the first time as a result of the internet search, I will allow an extension of up to 30 days from the request if it is requested with 30 days of their receipt of the necessary claim forms from the state. (Essentially this allows up to 60 days to compete the claim paperwork.)

Sincerely,

Paul J. Lipscomb
